Build identity from primary records. Obtain the Vietnamese enterprise registration, legal names in Vietnamese and English, enterprise code, registered address, legal representative, tax-invoice details, export capability, and bank-beneficiary letter. Independently retrieve or validate registration through the appropriate Vietnamese registry or qualified local counsel rather than accepting a salesperson’s screenshots. The contracting party should align with the invoice issuer and fund recipient. A trading company may be valid, but its role, producing factory, and margin should be explicit.
Verify the production address through a live or physical audit that records signage, production lines, warehouse, laboratory, personnel, utilities, and current activity. Which FDA requirements should the US importer map accurately?
For imported food, FDA says the Foreign Supplier Verification Programs (FSVP) rule generally makes importers responsible for verifying that foreign suppliers use processes providing the same public-health protection as applicable US preventive-controls or produce-safety requirements, and that food is not adulterated or misbranded regarding allergens. Activities vary with the food and risk. The FSVP importer is generally the US owner or consignee at entry, or a designated US agent or representative when none exists. Do not quietly assign this duty to the broker or Vietnamese exporter.
Facilities that manufacture, process, pack, or hold food for US consumption may have FDA registration duties, subject to exemptions. Imported food also generally needs prior notice before arrival. Verify registration directly where possible, identify the manufacturer rather than only the exporter, and place the correct FSVP importer identifier in entry data. Registration is not FDA product approval, a quality certificate, or evidence that FDA inspected and endorsed the facility.
Empty food-contact packaging requires a different analysis. What specifications should be signed before a deposit?
